1. About BookMyWave

BookMyWave is an online marketplace connecting customers with boat charter operators in Australia and beyond. We act as an intermediary platform only. BookMyWave is not the charter operator and is not responsible for the vessel, crew, or services provided by individual operators.

2. Eligibility

You must be at least 18 years of age to make a booking on BookMyWave. By using this platform you confirm that you have the legal capacity to enter into a binding agreement.

3. Bookings

When you submit a booking, you are making a request to hire a vessel for the specified date, time, and duration. For instant-approval boats, your booking is confirmed upon successful payment. For manual-approval boats, your card is authorised but not charged until the operator approves the request. If the operator declines, your authorisation is released immediately.

4. Cancellation & Refunds

Cancellation policies are set per vessel by the operator and displayed on each listing before booking. As a general guideline: cancellations made before the operator's free cancellation window receive a full refund; cancellations within the restricted window may receive a partial refund; no refund is available for cancellations made within 24 hours of the charter start time. Specific terms are shown at checkout.

5. Operator Responsibilities

Operators are solely responsible for the safety, seaworthiness, insurance, and licensing of their vessels. Operators must hold all required maritime licences and public liability insurance. BookMyWave does not verify vessel safety and makes no warranty as to the condition or fitness of any vessel.

6. Customer Responsibilities

Customers are responsible for ensuring their guest count does not exceed the vessel's stated capacity. Customers must comply with the operator's house rules as listed on the booking page. Any damage to the vessel caused by the customer or their guests may result in additional charges.

7. Service Partners

BookMyWave facilitates connections between customers and third-party service providers (photographers, caterers, DJs, etc.). These providers are independent contractors. BookMyWave is not responsible for the quality or delivery of services provided by third-party partners.

8. Platform Fees

BookMyWave charges operators a platform fee on each completed booking. This fee is deducted from the operator's payout. Customers pay the listed price inclusive of GST. No additional platform fees are charged to customers beyond the price shown at checkout.

9. Payments

All payments are processed by Stripe. By completing a booking you agree to Stripe's terms of service. BookMyWave does not store credit card details. Operator payouts are issued via Stripe Connect after booking completion, subject to Stripe's standard payout schedule.

10. Limitation of Liability

To the maximum extent permitted by Australian law, BookMyWave's liability for any claim arising from use of the platform is limited to the amount paid for the relevant booking. BookMyWave is not liable for indirect, incidental, or consequential damages including loss of enjoyment, injury, or property damage occurring during a charter.

11. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

12. Changes to These Terms

BookMyWave may update these terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated terms. We will notify registered users of material changes by email.
